• Marriage-based Consular Processing—where the US Citizen is living in the US and their fiance/spouse resides in the UK or another part of the world. We help the foreign national spouse apply for their Permanent Resident status in the US so they can legally reside in the US with their US Citizen spouse. We also represent spouses who are residing in the UK, where one spouse is a US CItizen and the other is the foreign national spouse. This usually comes about due to the US Citizen spouse being employed in the UK or working on their business in the UK. The couple usually meet and fall in love in the UK and then a change in circumstance leads to the couple seeking to move to the US as soon as possible.

• Marriage-based Adjustment of Status—where the US Citizen spouse and the foreign national spouse find themselves in the US and need a more permanent immigration solution for the foreign national spouse. In some situations the couple hasn’t even married yet but are thinking about their next steps to begin their lives together, united in purpose. We are able to guide them as to how they can achieve their short term and long term immigration goals, especially when they find that they may have to straddle a obligations in the US and the UK for a while until they have more flexibility for permanent solutions.

• Fiance Visa—this usually not the best option but it can work for foreign national spouses who need more to migrate to the US. In the post-pandemic world, it can take nearly a year and a half before the foreign national fiance can enter the US with a fiance visa. This also is an option that serves foreign national fiances who are unable to obtain any other visa or a visa waiver, thus are unable to travel to the USA. This also serves couples who are unsure of whether the foreign national partner can adjust to life in the US as it allows them to have a 90 day visit to the US, thereby giving them a chance to see if the US is a realistic option for them in terms of culture, career, or family. Unless someone finds one of these dynamics appealing, we would say that the spousal visa is the best option because the foreign national can enter the US as a permanent resident in the same amount of time it takes them to enter as a K-1, 90 day fiance.

We also deal with related cases such as when a permanent resident wants to become a US Citizen and therefore, maintain dual UK and US Citizenship or when a permanent resident becomes a US Citizen and wants to sponsor their parents to live in the US, amongst many other family petitions.
